LEGAL BASIS FOR PARTICIPATION IN THE SWEEPSTAKES
GIANT
1.- COMPANY ORGANIZING THE PROMOTION
The Company ALL IN BIKING with address at Muelle 6, Zona Levante S/N, Módulo 14, local 1, 03001 Alicante, identified with CIF number B67739557, organizes the sweepstakes (hereinafter, “the Promotion”) of national scope, to be carried out through the Internet, exclusively for users residing in Spain in accordance with the provisions of the participation requirements section.
The purpose of this sweepstakes is to reward the loyalty of App users.
2.-START AND END DATES
The Promotion will start on July 7, 2023 at 14.00h, and will end on July 21, 2023 at 23.45h. The Company reserves the right not to proceed with the promotional action if there has not been a participation of more than 100 users by the date shown at the beginning of the promotion.
3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The requirements for participation are as follows:
Participation is open to those who reside in Spain and are over 18 years of age.
Only Participants who have an Instagram or Facebook account and follow the ALL IN BIKING profile and the GIANT Spain profile on these social networks are eligible to participate.
Participants must be registered in the ALL IN BIKING app.
Participants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles they will be disqualified.
Participants must mention a friend in the comments, each mention implies one more participation in the sweepstakes itself.
CONDITIONS OF THE PROMOTION AND PRIZES
The winner will be chosen randomly from the participants and checked for compliance with all requirements. If any requirement is not met, a winner will be chosen again among the comments made and all the requirements will be checked (and so on, if necessary). The winner will be announced in the next 3 days from the closing of the sweepstakes through the brand’s social profiles.
The prize will consist of a PROPEL ADVANCE PRO 0 DI2 bicycle, which belongs to the AERO range of the GIANT brand.
The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The Company reserves the right to modify the prize if on the day of declaring the participant as the winner there are problems of stock of the prize and, therefore, it is impossible to give the prize.
The winner may contact the Company during a period of 5 days from the date on which it is announced on the social profile of the brand. If no such contact is made within the stipulated period, the sweepstakes will be declared void.
The holding of the draw and the awarding of the prize are subject to the tax regulations in force.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion and will lose all rights to the prizes awarded under this Promotion.
The Company reserves the right to declare the draw void.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image will not be allowed. We will not be responsible for any damage caused by the comments made by the Participants in the Promotion, which at any time could hurt the sensitivity of other Participants.
Participation in this Promotion, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.
If fraudulent means of participation, such as the use of bots in the comments, are discovered by the Company, the prize will not be awarded and will remain the property of the Company.
7.-EXONERATION OF LIABILITY
By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize.
In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.
8.- PROTECTION OF PERSONAL DATA
The Company responsible for the treatment of your data is All In Biking SL with address at Muelle 6, Zona Levante S/N, Módulo 14, local 1, 03001 Alicante and identification number B67739557.
In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data will be incorporated into a file, owned by it, in order to manage the draw, as well as to disseminate and publicize its results, and process the delivery of the prize.
Please note that you can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to protecciondedatos@allinbiking.com or by letter to the following address: Muelle 6, Zona Levante S / N, Module 14, local 1, 03001 Alicante, attaching in both cases a copy of an identification document.
Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in case he/she does not see his/her rights satisfied.
Therefore, the Participant declares that he/she has been informed of the conditions on personal data protection, accepting and consenting to the processing.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion.
The mere fact of participating in the sweepstakes implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the social network Instagram through which the sweepstakes takes place.
10.- APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the Participant’s city of residence will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
